LIABILITY WAIVER AND RELEASE FORM

PLEASE READ CAREFULLY BEFORE SIGNING

In consideration of being permitted to participate in any way in the Brazilian Jiu-Jitsu program indicated below and/or being permitted to enter for any purpose any restricted area (herein defined as any area wherein admittance to the general public is prohibited), the participant named below agrees:

ACKNOWLEDGMENT OF RISKS

I, the undersigned, fully understand and acknowledge that:

a) Brazilian Jiu-Jitsu and related activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis, and death (\"Risks\");

b) These Risks may be caused by my own actions or inactions, the actions or inactions of others participating in the activity, the conditions in which the activity takes place, or the negligence of the \"Releasees\" named below;

c) There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time;

d) I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the activity.

REPRESENTATIONS REGARDING PHYSICAL CONDITION

I represent that:

a) I am in good physical condition and have no disability, illness, or other condition that could prevent me from engaging in these activities without risk or injury to myself or others;

b) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in these activities;

c) I have consulted with a physician before participating in this activity if I have any concerns about my physical ability to engage in Brazilian Jiu-Jitsu training.

RELEASE AND WAIVER OF LIABILITY

I hereby release, discharge, and covenant not to sue Guardian BJJ Academy, its respective administrators, directors, agents, officers, volunteers, employees, other participants, sponsors, advertisers, owners and lessors of premises on which the activity takes place (each considered one of the \"Releasees\" herein), from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

CONSENT TO MEDICAL TREATMENT

I hereby give consent to Guardian BJJ Academy to obtain emergency medical treatment for me if I am injured or require medical attention during my participation in this activity. I understand that Guardian BJJ Academy is not responsible for any resulting medical bills or other expenses I may incur.

MEDIA RELEASE

I hereby grant Guardian BJJ Academy permission to use my likeness in photographs, videos, or other digital media in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all media will become the property of Guardian BJJ Academy.

AGREEMENT TO COMPLY WITH RULES

I agree to comply with all rules imposed by Guardian BJJ Academy regarding participation in Brazilian Jiu-Jitsu activities. I agree to inspect the facilities and equipment before using them and will not participate if I believe anything is unsafe.

FOR PARTICIPANTS OF MINORITY AGE (UNDER 18 AT TIME OF REGISTRATION)

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, even if arising from the negligence of the Releasees, to the fullest extent permitted by law.

ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
